When you receive a notice of appeal or an application for leave to appeal, you can check whether the person or enterprise intending to sue you has been identified as a litigant subject to authorization – i.e., a quarrelsome litigant.
This designation results from a judicial order which may have been issued, among other things, following numerous unjustified legal proceedings.
There is a Public registry of litigants subject to authorization by the Court of Appeal of Quebec. This public registry is kept by the Ministère de la Justice and is available for consultation on its website.
The public registry contains:
- the names of persons and enterprises subject to an order of the Court of Appeal of Quebec declaring them litigants subject to authorization; and
- the content of each order.
The order limits the right of the person or enterprise concerned to act before the Court, since the person or enterprise must obtain authorization from a judge of the Court before launching any legal action.
