Appeals on Merits

  • The Court begins to sit at 9:30 a.m. (unless otherwise specified).

  • For counsel, the wearing of a “gown, bands, white collared shirt and dark garment” are obligatory.

  • In civil matters, in accordance with section 45 of the Regulation of the Court of Appeal of Quebec in Civil Matters, a party who becomes aware of a circumstance (such as discontinuance (art. 213 C.C.P.), transaction (arts. 217 and 220 C.C.P.), bankruptcy or other circumstance) that terminates or suspends the appeal shall inform the clerk without delay.

Important

  • Emergency hearing: If you consider that you need to be heard urgently, you must contact the clerk during opening hours, Monday to Friday from 8:30 a.m. to 4:30 p.m. and inform the clerk in advance that an emergency hearing may be necessary in your case. The clerk will contact you quickly to assess the urgency of the request and to organize the arrangements for the hearing, if applicable.

Applications Before a Panel of Judges

  • A limited number of applications/motions are heard on each hearing day, hence the need to reserve a place on the roll.

  • The party who presents an application or a motion before a panel of judges (i.e., a panel of three judges) shall reserve a presentation date with the clerk and file the application/motion within five working days of the date on which this reservation was made. Failure to submit the application/motion within this time limit will result in the reservation being cancelled without further notice. However, a new reservation can be made (section 66 par. 5 R.C.A.Q.Civ.M., section 53 par. 5 R.C.A.Q.C.M. and section 50 par. 5 R.C.A.Q.P.M.) [Montreal: 514‑393‑2022; Quebec: 418-649-3401]. For the available dates for presenting an application or a motion before a panel of judges (i.e., a panel of three judges), consult the section “Calendars of hearing days of applications/motions”.

  • For an application or a motion to be put on the roll, it must be accompanied by all the documents necessary for its adjudication. For more details on this, see section 54 R.C.A.Q.C.M. for applications in criminal matters, section 51 R.C.A.Q.P.M. for applications in penal matters and sections 32 and 67 R.C.A.Q.Civ.M. for the Application for Leave to Appeal and for the other types of applications.

  • Unless the parties previously obtained special authorization to plead for a longer period of time, each party whose case is on a roll of applications before a panel of judges (i.e., a panel of three judges) will have a maximum hearing time of 15 minutes.

  • For counsel, the wearing of a “gown, bands, white collared shirt and dark garment” are obligatory.

  • In Montreal, applications/motions presentable before a panel of judges (i.e., a panel of three judges) are usually heard on Monday of each week when the Court sits in the Pierre-Balise Mignault Room (RC-08) at 9:30 a.m.

  • In Quebec City, applications/motions presentable before a panel of judges (i.e., a panel of three judges) are usually heard on Monday, once a month, when the Court sits in Room 4.33 at 9:30 a.m.

Emergency hearing of applications/motions: If you consider that you need to be heard urgently, you must contact the clerk during opening hours, Monday to Friday from 8:30 a.m. to 4:30 p.m. and inform the clerk in advance that an emergency hearing may be necessary in your case. The clerk will contact you quickly to assess the urgency of the request and to organize the arrangements for the hearing, if applicable.

 

Applications Before the Judge Alone or the Clerk

  • A limited number of applications/motions are heard on each of the hearing days, hence the need to regularly check the schedules of days available to present an application or a motion to ensure that there are still places available on the roll. To do this, consult the section “Calendars of hearing days of applications/motions”.

  • For an application or a motion to be put on the roll, it must be accompanied by all the documents necessary for its adjudication. For more details on this, see section 54 R.C.A.Q.C.M. for applications in criminal matters, section 51 R.C.A.Q.P.M. for applications in penal matters and sections 32 and 67 R.C.A.Q.Civ.M. for the Application for Leave to Appeal and for the other types of applications.

  • Unless the parties previously obtained special authorization to plead for a longer period of time, each party whose case is on a roll of applications before a judge sitting alone will have a maximum hearing time of 15 minutes.

  • The wearing of a gown is not obligatory for counsel. Applications/Motions that fall within the jurisdiction of the clerk are heard at 9:00 a.m.

  • In Montreal, applications/motions presentable before the judge alone are heard daily in Room RC-18 at 9:30 a.m.

  • In Quebec City, applications/motions presentable before the judge alone are heard daily in Room 4.30 at 9:30 a.m.
